1. Introduction
Welcome to BauDar (baudar.com), a platform where users can post and view announcements related to pets (lost, sighted, etc.).
By accessing or using BauDar, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the site.
2. Who We Are
BauDar is managed by a single independent developer based in Italy (“BauDar”, “we”, “us”).
Site Owner: Adrian Ivascu
General Email: supporto@baudar.com
Reports/Abuse (including authorities): report@baudar.com
Owner's Email: ivascu.adrian@proton.me
The processing of personal data is governed by our Privacy Policy.
2.1 Points of Contact (DSA)
Pursuant to Regulation (EU) 2022/2065 – Digital Services Act:
- Authorities/Commission/Board (Art. 11): report@baudar.com
- Users (Art. 12): supporto@baudar.com
Supported languages: Italian and English. These channels do not rely exclusively on automated tools.
3. Nature of the Service
BauDar is a community-based platform where users can:
- Post announcements for lost or found pets
- View and comment on announcements
- Share and access geographical data related to sightings
- Close announcements and report the outcome of the search
- Optionally share recovery stories, photos, and details in the "Di nuovo a casa" section
- Optionally use artificial intelligence features, for example to recognize an animal's characteristics from photos (Section 3.4)
BauDar is not an animal shelter, a recovery service, or a competent authority. It is a neutral site where users publish content independently. BauDar does not verify or guarantee the authenticity, accuracy, or completeness of content published by users. We may, however, subject content to automated or manual checks to assess its compliance with the platform rules.
Not for emergency use. BauDar is not an emergency service or a reporting service for authorities. In situations of danger or urgency, contact your local emergency numbers.
3.1 Future Features and Paid Options
The service is currently free. In the future, we may introduce paid features (e.g., promoting announcements) or a small shop. In such a case, we will provide additional information and, if necessary, specific conditions.
3.2 Territorial Scope of Use
The service is primarily designed for use in Italy. Access from other countries is permitted, but features and support may be limited. The use of the service is subject to the applicable law specified in these Terms.
3.3 Official Procedures and Legal Reminders
During the announcement creation process, BauDar displays mandatory reminders regarding official procedures. These are summary notes provided for awareness only and do not constitute legal advice.
By using the service, you acknowledge that:
- Posting an announcement on BauDar does not replace any official report or notice required by law.
- You are solely responsible for knowing and complying with the laws in your jurisdiction (e.g., filing a report with the Police/Carabinieri or notifying the ASL/Veterinary Services).
- BauDar is not responsible if you fail to fulfill these legal obligations.
3.4 Artificial Intelligence Features
Some BauDar features use artificial intelligence, for example to recognize an animal's visible characteristics from photos while you create an announcement or search for an animal. They are marked as AI, are optional and start only if you launch them: you can always fill in or search manually.
- Results are suggestions, may be incomplete or wrong and must be checked before you use them. They do not certify an animal's breed, age, sex, health or identity, and a search result does not guarantee that it is the animal you are looking for. The content of the announcements you publish remains your responsibility (Section 5).
- By starting a photo analysis you authorize us to send the photos, solely for that analysis, to the AI providers listed in the Privacy Policy (Section 4.l), which describes the processing. Use photos you have the right to use and avoid, as far as possible, people, documents, license plates or other personal data.
- We may limit the number of uses, per account, per connection or in total; a started analysis may count towards the limits even if you cancel it or it gives no results. You may not circumvent these limits, for example with multiple accounts, by changing connection or with automated tools, nor use these features for purposes unrelated to BauDar or to analyze images that do not concern animals.
4. User Account
- You can browse and publish announcements without an account.
- To comment or interact in other ways, you must create an account.
- Authentication is managed via Firebase (Google or email).
You are responsible for the security of your account and for all activities that occur under it.
4.1 Minimum Age and Eligibility
To use BauDar, you must be at least 14 years old (pursuant to Art. 2-quinquies of Italian Legislative Decree 196/2003). If the law in your country requires a higher age to validly consent to online services, you must be at least that age or use the service with the consent/authorization of a parent or guardian. For minor users, the use of the service also implies the acceptance of these rules of use by the holder of parental responsibility.
5. User Responsibility
By accepting these Terms, you assume full responsibility for the content you publish and for your actions. Your use of BauDar is subject to two fundamental conditions:
- Compliance with the Law: It is strictly forbidden to use the platform for any illegal purpose or to promote activities that violate applicable laws.
- Adherence to Community Rules: You must comply with the specific rules of conduct detailed in Section 6.
5.1 Mandatory Acknowledgements for Publication
To publish specific types of announcements (e.g., Lost or Sighted/Found pets), we require you to complete a mandatory checklist confirming that you:
- Accept these Terms of Service;
- Have read the Privacy Policy;
- Have read and understood the legal obligations related to your situation (e.g., the duty to report a lost pet or the prohibition of detaining a found animal).
These acknowledgements are mandatory to proceed. If you do not complete the checklist, you cannot proceed with publication.
6. Community Rules and Moderation Policy
Our goal is to keep BauDar a safe, constructive, and focused environment for its purpose: helping pets and their owners. Therefore, all users are required to respect the following rules.
Important Note: The following list is illustrative and not exhaustive. We reserve the right to take action against any content or behavior that, in our sole and absolute discretion, we deem harmful, inappropriate, or contrary to the spirit of the platform, even if not explicitly mentioned in this list.
6.1 Prohibited Content
It is strictly forbidden to post content, including announcements, recovery stories, comments, images, or messages, that includes:
- a. Scams, Blackmail, and Deceptive Activities
- Ransom demands, blackmail, or extortion, pretending to have found a pet to extort money from the rightful owner.
- Deliberately providing false hope or misleading information, for example, by contacting an owner claiming to have seen their pet just to cause emotional distress or for ulterior motives.
- Blatantly false announcements created to upset the community or as a prank.
- Links to phishing sites that imitate BauDar or other services to steal credentials.
- Unverified and unauthorized requests for donations or fundraising.
- b. Illegal, Dangerous, or Disturbing Content
- Images or descriptions of explicit violence, cruelty, mistreatment, or abuse of animals or people.
- Content that promotes or encourages illegal activities (e.g., animal fighting, poaching).
- Dangerous or harmful advice regarding animal health or human safety.
- Shocking images of injured or deceased animals, unless strictly necessary for identification.
- c. Hate, Harassment, Bullying, and Privacy Violations
- Personal attacks, insults, vulgar or derogatory language directed at other users.
- "Owner shaming": blaming or humiliating the owner of a lost pet.
- Discriminatory content based on ethnicity, religion, gender, sexual orientation, disability, or otherwise.
- Publishing another person's private information without their consent (doxing).
- d. Spam, Advertising, and Self-Promotion
- Announcements for the sale of animals, litters, or commercial services.
- Repetitive, identical, or low-quality comments ("copy-paste").
- Links to websites, blogs, social media channels, or personal crowdfunding campaigns that are not directly relevant and authorized.
- Automatically generated content (spam from bots or AI) and/or without any informational value.
- e. Irrelevant or Off-Topic Content
- Announcements that are not about lost, found, or sighted pets.
- Using comments for political, religious, personal, or other debates unrelated to the announcement.
- f. Intellectual Property Infringement
- Publishing copyrighted content for which you do not hold the rights. This includes, for example, photos taken by others (photographers, other users) or text copied from other sites or announcements. By uploading content, you declare that you have all the necessary rights to do so.
6.2 Prohibited Behaviors
In addition to content, the following actions on the platform are forbidden:
- a. Impersonation
- Creating a profile pretending to be another real person.
- Falsely claiming to represent an authority (e.g., Local Police, health authorities) or an organization.
- b. Misuse of Contact Information
- It is strictly forbidden to collect or use the contact information (phone numbers, emails) found in announcements for any purpose other than the intended one, which is to contact the poster regarding the announcement itself. Prohibited uses include, but are not limited to:
- Sending advertising, spam, or promotional material (marketing).
- Adding contacts to mailing lists or commercial databases.
- Harassment, threats, or sending unsolicited and inappropriate communications.
- Contacting the user to criticize, judge, or offer unsolicited opinions.
- It is strictly forbidden to collect or use the contact information (phone numbers, emails) found in announcements for any purpose other than the intended one, which is to contact the poster regarding the announcement itself. Prohibited uses include, but are not limited to:
- c. Platform Manipulation and Abuse
- Creating multiple accounts to evade a suspension or to harass a user.
- Exploiting bugs or vulnerabilities of the site instead of reporting them responsibly.
- Using the reporting system to harm another user by massively and baselessly reporting their content.
6.3 Measures and Consequences of Violations
We act to enforce these rules in a fair and proportionate manner. The measures we take are not necessarily progressive and depend on the severity of the violation, the context, and the user's history.
- A minor violation (e.g., an off-topic comment) may result in a simple warning or the removal of the content.
- A serious, patently illegal violation, or one that puts people or animals at risk (e.g., a scam, a ransom demand, threats, content promoting cruelty) may lead to the immediate and permanent suspension or ban of the account, without prior notice.
Our goal is to protect the community. Every decision is made at our sole discretion, but always with the aim of being fair and consistent.
Furthermore, we reserve the right to report to the competent authorities (e.g., Postal Police, law enforcement agencies) any content or behavior that we believe may constitute a criminal offense, providing the information in our possession in compliance with current regulations.
7. Public Nature of Content
Content made public through BauDar may be visible to anyone and indexed by search engines. This may include announcements, comments, recovery records, stories, photographs, and other information that, depending on how the service works and the user's choices, is publicly accessible.
Users are responsible for:
- Choosing what to share
- Avoiding the unnecessary publication of personal data or information concerning third parties
- Ensuring that they have the necessary rights and permissions for the content they publish
BauDar cannot guarantee the immediate removal of copies that may already have been indexed, stored, or shared by search engines or other external services.
7.1 Announcement Lifecycle and Visibility Rules
To ensure that the map shows relevant and up-to-date information, announcements follow a strict lifecycle involving three visibility states: Listed, Unlisted, and Private (Archived).
0. Pending Review (Pre-Publication & Revisions)
- New Announcements: When you first create an announcement, it enters a "Pending" state and is not visible publicly until approved by our automated systems or moderators.
- Edits and Revisions: If you edit an already active announcement, a new revision is created and enters the review process.
- The previous approved version remains publicly visible ("Listed") or any state it was before.
- Once the new revision is approved, it automatically replaces the old version on the platform.
- If the new revision is rejected, the old version remains active.
1. Active State ("Listed")
- Once approved, the announcement becomes publicly visible to everyone (on maps and lists on BauDar's website).
- It remains active for a specific duration (e.g., approx. 30 days).
2. Expiration or Closure and Unlisted Status
- When an announcement expires or is closed, it no longer appears on public maps or in lists of active reports.
- The announcement may nevertheless remain accessible via direct link and from the user's dashboard for a limited period.
- An expired announcement may, where available, be reactivated within the limits and timeframes indicated by the service.
- A closed announcement is no longer considered an active report and cannot be reopened as such.
3. Archiving and "Private" State
- After a certain period, an expired or closed announcement may be automatically archived.
- The user may also archive it earlier, where this functionality is available.
- Once archived, the announcement is no longer publicly accessible and is visible only to the user in their personal area.
- Irreversibility: An archived announcement cannot be reopened or reactivated.
4. Deletion
- By User: You can permanently delete your announcement at any time. This action is irreversible.
- By Moderator: We reserve the right to remove or take down any announcement at any time, without notice, for violations of these Terms or for other reasons.
7.2 Recoveries and the "Di nuovo a casa" Section
When an announcement relating to a lost pet is closed indicating that the animal has been found alive, BauDar may create a recovery record in the "Di nuovo a casa" section.
The user may choose to publicly share the recovery by linking it to their announcement or keep it in a minimal form.
If the recovery is shared publicly, the record may display, according to the user's choices, information such as the animal's name and photographs, the area, available dates, the recovery story, the public profile name, and a link to the original announcement.
If the user chooses not to publicly share these details, a minimal record containing general information such as species and region, without the animal's name, may remain visible.
Adding photographs and a story is optional. Such content may be subject to moderation before publication or following later changes. During review, the recovery record or the last approved version may remain visible.
Information about the circumstances of the recovery is provided by the user. BauDar does not independently verify or guarantee that the animal was found in the manner described or as a result of using the platform.
The user may later modify their story or remove the story text and any additional photographs. If the story is removed, the minimal recovery record may remain visible.
Deleting the original announcement does not automatically delete the associated recovery story, which may be managed separately through the features available within the service.
8. Content Moderation and Reporting System
To enforce the rules defined in Section 6, BauDar employs a mixed moderation system, which combines human review and technological tools.
At our discretion, content may be analyzed by artificial intelligence (AI/LLM) systems, forwarded directly for review by a human moderator, or handled based on other internal criteria. We reserve the right to remove, restrict the visibility of, or subject content to review in accordance with these Terms and applicable law.
Moderation is not guaranteed to be real-time or exhaustive.
Transparency of decisions (DSA). In the event of an intervention on content or an account, we provide a brief statement of reasons indicating the violated rule and whether automated systems (AI/LLM) were used in support.
8.1 Reports and Removals (Notice & Action)
We provide channels for reporting potentially illegal content or content that violates these Terms: the “Report” button next to announcements and the email address report@baudar.com (which can also be used by authorities/legal representatives).
To help us act quickly, your report should include:
- The exact URL (or URLs) of the content;
- A clear description of the reason for the illegality/violation and, if possible, the legal reference (e.g., copyright, defamation, personal data);
- Your contact details (email) if you wish to receive a response;
- A statement made in good faith that the information in the notice is accurate.
If we deem the report to be well-founded, we may remove or restrict access to the content. When we take action on a user's content, we send a brief statement of reasons, unless prevented by law or if it poses a risk to third parties. It is possible to file an appeal by replying to our communication within 14 days; we will review the case at our discretion. In the presence of serious or repeated violations, we may suspend or close the account and/or inform the competent authorities. If the report contains an electronic contact address, we will send confirmation of receipt and, without undue delay, communicate the outcome of the decision and the possibilities for appeal.
When processing reports of illegal content, we may process the data of the reporter (e.g., email contact) and of the author of the reported content, to assess and follow up on the request, also pursuant to Art. 6.1.c GDPR (compliance with legal obligations such as Italian Legislative Decree 70/2003 and the DSA).
For general assistance or questions about the service, use supporto@baudar.com.
For institutional or formal contacts, ivascu.adrian@proton.me is also available.
8.2 Human Verification (CAPTCHA) and Prohibited Use of Bots
To access certain features (e.g., posting announcements or comments, viewing contacts), we may require human verification through systems like Cloudflare Turnstile. It is forbidden to circumvent or attempt to circumvent such mechanisms, use bots or automation to interact with the platform, or interfere with their proper functioning.
8.3 Internal Complaint-Handling System (Art. 20 DSA)
We provide a free and simple internal complaint-handling system to challenge decisions regarding content or accounts.
Deadline for submitting a complaint: up to 6 months from the notification of the decision.
Outcome: a response without undue delay (operational target: within 14 days).
The complaint can be submitted by the user concerned through the channels indicated in the received communication or by writing to supporto@baudar.com.
8.4 Trusted Flaggers and Priority (Art. 22 DSA)
Notices submitted by trusted flaggers designated under the DSA may be processed with priority.
8.5 Suspension of Repeat Infringers (Art. 23 DSA)
In case of serious or repeated violations, we may suspend for a reasonable period the ability to post or use specific features, following a prior warning. The duration and scope of the measure will be proportionate and indicated in our communication, which includes a brief statement of reasons and whether automated systems (AI/LLM) were used in support.
Progressive measures (examples):
- A warning and a request for compliance.
- Temporary suspension of the account or specific features (e.g., posting/commenting).
- A permanent ban in case of recidivism or particularly serious violations.
Appeal and deletion post-ban. In the event of a permanent ban, you can:
- submit an appeal/challenge within 30 days of the ban notification; in this case, we will suspend the deletion of the account until the outcome;
- still use the internal complaint-handling system within 6 months (Art. 20 DSA). However, if the account has already been deleted, we may not be able to restore the data or the account.
If we do not receive an appeal within 30 days and 60 days have passed since the final ban notification (or if the appeal is rejected), we may proceed with the deletion of the account and associated data, without prejudice to legal retention obligations, our legitimate interests for legal defense, and the technical backup timelines specified in the Privacy Policy.
8.6 Pre-Publication Review and Editing
BauDar employs a preventive review system to filter spam, scams, and illegal content.
- Routing Logic: We use internal criteria to determine whether certain content may be published directly, reviewed by automated systems, or sent for human moderation. These criteria may include, for example, account characteristics, anti-abuse signals, and content analysis.
- Edits (Revisions): Changes to certain content, including announcements and recovery stories, may be subject to a new review. Where a published version already exists, it may remain visible until the changes are approved.
- No Guarantee: We do not guarantee immediate publication. We reserve the right to reject any content that does not meet our standards, without necessarily providing a detailed justification for every rejection.
9. Rewards and Transactions
Some announcements may include rewards. BauDar:
- Does not manage payments or verify payment conditions
- Is not a party to any agreements between users
- Is not responsible if a reward is not honored
Users must act with caution and verify the identity of others before making commitments.
Relationships between users and the platform's role. BauDar does not intervene in communications or agreements between users and acts as a mere technical intermediary (hosting provider) with respect to the content published by users.
Third-party content/services. The site may incorporate third-party components (e.g., maps, libraries). Their use is subject to the terms of the respective providers; we do not guarantee the availability, accuracy, or continuity of such services.
10. Real-World Usage Disclaimer
Using BauDar may involve real-world activities (e.g., map-based searches). By accessing the site, you agree to:
- Pay attention to your surroundings
- Not put yourself in danger
- Not violate private property or local laws
- Not blindly follow information from maps or announcements
We are not responsible for accidents, damages, violations, or risks arising from the use of the site in public or private spaces.
10.1 Specific Obligations for Lost and Found Pets
BauDar helps disseminate information but does not replace official procedures. By creating an announcement, you acknowledge that you have read the reminder shown in the flow and you agree to act in compliance with local laws and instructions from competent authorities, especially where the service is primarily designed to operate (Italy / EU).
A. If your pet is lost
- Publishing an announcement on BauDar does not substitute any required official report/notice.
- You may need to notify competent authorities (e.g., local law enforcement or municipal services) and update the status of any official pet identification/registry (e.g., microchip/registry) through the competent channels, following the procedures applicable in your area.
B. If you sight or find a domestic animal
- You may be required to notify the competent authorities promptly and follow their instructions (including where to bring the animal and what documentation is needed).
- If the animal is injured or in immediate danger, contact emergency services first and do not put yourself or others at risk.
- If you temporarily keep the animal to ensure safety, you must do so responsibly and in accordance with instructions from the competent authorities.
- You can help identification by checking any visible tag/medal; for microchip reading, follow local best practices (e.g., contacting a veterinarian or competent services).
Procedures and timelines can vary by municipality/region and by the specific circumstances. Always rely on official instructions. Failure to comply with these official procedures is the sole responsibility of the user.
11. False Announcements, Scams, and Extortion
BauDar is an open platform and does not preemptively verify the identity of users or the authenticity of announcements. It is your responsibility to act with caution. Be aware that there may be:
- False, misleading, outdated, or prank announcements.
- Users who pretend to have found a pet to fraudulently obtain a reward, to extort money, or to phish for personal information.
We do not guarantee that a announcement is legitimate. If you suspect a scam, blackmail, or other illegal activity, cease all communication and contact the competent authorities immediately. BauDar is not responsible for the consequences arising from such interactions.
12. Intellectual Property
- Users retain the rights to their own content
- By posting, you grant BauDar the right to display and store it
- You may only upload content for which you own the rights
The BauDar name, logo, and platform are the property of the operator.
12.1 License on User Content
Users retain the rights to the content they publish. By posting content on BauDar, you grant BauDar a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license, limited to the purposes of providing, maintaining, and promoting the platform.
This license includes the right to host, reproduce, distribute, communicate to the public, display the content, and create technically necessary adaptations (e.g., thumbnails, crops, recompression, format conversions, automatic translations, or transcriptions), including through providers who assist us with hosting and moderation.
When you delete content, we will remove it within a reasonable time; residual copies may temporarily persist in backups or where third parties have already stored/shared it.
User Representations. By posting content, you represent that you have the necessary rights (or permissions) to grant this license, that the content does not violate third-party rights (including copyright and the rights of individuals portrayed), and you indemnify BauDar from third-party claims arising from your publication.
13. Availability, Maintenance, and Abuse Control
We do our best to keep the site active, but:
- There may be interruptions for maintenance, updates, or malfunctions
- We may limit access in case of abuse or excessive use
- We may modify or remove features at any time
- The service may be suspended or permanently terminated at any time, without notice
14. Account Closure
You can close your account at any time:
- from the Account Settings (after logging in), or
- by writing to supporto@baudar.com from the same email associated with the account.
Inactive accounts. If you do not sign in for 24 months, we delete the account together with its data, as described in the Privacy Policy. About 30 days before, we warn you by email: if you sign in before that date, your account stays active.
We may suspend or ban users who violate these Terms, particularly the rules defined in Section 6, or who act in a harmful manner. In the event of a permanent ban, we will communicate the reasons, the rules violated, and the appeal options. You have 30 days to file an appeal (deletion will be suspended until the outcome) and, in any case, you can use the internal complaint-handling system within 6 months (Art. 20 DSA).
If the ban becomes final and 60 days pass without a successful appeal, we may proceed with the deletion of the account and data, subject to the minimum retention required by law or for legal defense, and the technical backup timelines described in the Privacy Policy.
Content without an account or already shared. If you have posted content without registering or have shared it publicly, some elements may remain visible; you can still request their removal separately.
15. Limitation of Liability
BauDar is provided “as is” and “as available”.
We are not liable for:
- accidents, damages, or consequences arising from the use of information published by users (e.g., real-world searches, contact with strangers, rewards, etc.);
- false, outdated, or misleading content uploaded by users;
- temporary service interruptions, data loss, or malfunctions not under our control.
BauDar's liability is limited solely to cases where willful misconduct (intentional) or gross negligence on our part is proven, as provided by law. Pursuant to Art. 16 of Italian Legislative Decree 70/2003, we are not liable for the information stored as long as we have no actual knowledge of its illegality; in such a case, we will act promptly.
In all other cases, your use of the platform is at your own responsibility and at your own risk.
16. Indemnification
You agree to indemnify and hold harmless BauDar, its operators, and collaborators from any third-party claims, damages, liabilities, costs, and reasonable legal fees arising from:
- content you post or your activity on the site;
- your violation of these Terms or the law;
- your violation of any third-party rights (including copyright or personality rights).
17. Digital Accessibility (Current Status and Commitments)
We are currently progressively improving the accessibility of the platform. According to regulations:
- EU Directive 2016/2102 applies to the websites/apps of Public Administrations.
- In Italy, Legislative Decree 76/2020 extended accessibility obligations to private entities with an average turnover > €500 million over the last three years.
- The European Accessibility Act (Directive 2019/882) imposes requirements on specific products/services starting from June 28, 2025. In Italy, it is implemented by Legislative Decree 82/2022. Microenterprises providing services are exempt from the obligations set forth in the directive.
BauDar is a small-scale project and currently does not fall into the obligated categories. Nevertheless, we consider accessibility a quality priority: we plan to progressively align with the WCAG 2.2 AA / EN 301 549 guidelines. You can help us by reporting issues or pages that are difficult to use to supporto@baudar.com (subject: “Accessibility”), indicating: URL, component (e.g., form, map), device/browser, and assistive technology used (if any).
18. Governing Law
These Terms are governed by the laws of Italy and the European Union.
For consumer users residing in Italy, the competent court is the court of the consumer's place of residence or domicile.
For non-consumer users or users residing outside of Italy, the competent court is the Court of Bergamo (Italy).
19. Entire Agreement and Severability
These Terms constitute the entire agreement between you and BauDar regarding the service.
If any provision is deemed void or invalid, the remaining provisions shall remain in full force and effect.
In case of discrepancies between language versions, the Italian version shall prevail.
20. Updates and Changes
These Terms may change in the future. In the event of significant changes, we will inform users on the site or via email.
